Assumption of Risk for Participation

The practice of Capoeira frequently involves substantial risks of bodily injury, property damage, and other dangers associated with any physical activity. Dangers peculiar to practice of capoeira include, but are not limited to, broken bones, strains, sprains, bruises, concussion, and heart attack. Each participant should realize that there are risks, hazards, and dangers inherent to physical activities and in any training program.

It is the sole responsibility of each participant to participate only if they/he/she has the prerequisite skills, qualifications, preparation, and training. If the participant is concerned that they/he/she is lacking any of these areas, it is the sole responsibility of the participant to inform the instructor.

The undersigned hereby acknowledges and agrees that participation in capoeira, as delivered according to guidelines of the Capoeira and Brazilian Cultural Arts Center (thereafter CBCAC), inherently involves risk of physical injury and/or damage to property. In consideration for being permitted to participate and for the benefits received by such participation, the undersigned voluntarily assumes all risks of damages and injury, including death, that may be sustained by him/her/their or by his/hers/their property while participating in the practice of capoeira. Release, Covenant Not to Sue and Wavier

For the sole consideration of CBCAC and its instructors allowing the undersigned to participate in capoeira classes, the undersigned hereby agrees to release relieve, covenant not to sue and forever discharge, indemnify and hold harmless, and on behalf of their self/himself/herself and the undersigned’s heirs, representatives, executers, administrators and assigns, does hereby release, relieve, covenant not to sue and forever discharge, indemnify and hold harmless, the CBCAC and its trustees, officers, instructors, members, and volunteers of any and from all claims, demands, rights, liabilities, losses, expenses, and causes of action (with the exception of gross negligence or willful misconduct) or whatever kind of nature, including but not limited to, negligence, foreseen and unforeseen bodily and personal injuries, damage to property, and the consequences thereof resulting from any participation in capoeira as delivered by the CBCAC and its associates.

I understand that this assumption of risk and release, covenant not to sue and waiver shall cover any and all activities in which I participate. By signing this document, I hereby acknowledge that I have carefully read and fully understand the above before signing, and agree to comply with all of the above as of the date marked next to the signature.
